We strive to ensure our services are continuously available. However, we do not guarantee uninterrupted access and reserve the right to suspend Services for maintenance, upgrades, or other necessary reasons.
5.3 Server Downtime and Grace Period
We aim to maintain high availability, but occasional downtime may occur due to scheduled maintenance or unforeseen technical issues. We require a grace period of up to 1 day per calendar month for such downtime. Any downtime within these working hours will not result in liability, refunds, or service credits. In the event of downtime exceeding this allowance, please get in touch to discuss.
6.1 Content Ownership
You retain ownership of any Content you upload to the Lumin XR website. However, by uploading Content, you grant Lumin XR a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your Content for the purpose of providing our Services and used in demonstration for client-facing media, such as marketing on social media. We will avoid branded material and will not sell your content unless you give us permission explicitly.
6.2 Licence Grant
You grant Lumin XR the right to store, adapt, and transmit your content as necessary to provide our Services.
6.3 Prohibited Content
You must not upload Content that is unlawful, defamatory, obscene, infringes any intellectual property rights, or violates applicable laws.
6.4 User Responsibility
It is your responsibility to ensure that your Content does not infringe on any third-party rights. Lumin XR is not liable for any Content uploaded by Users.
7.1 Pricing
All prices for our Services are listed on our website and are subject to change. Prices include applicable taxes unless otherwise stated. We will endeavour to provide notice of price changes before they take effect.
7.2 Payment Methods
We accept various payment methods, including credit/debit cards and online payment systems. By providing payment details, you represent and warrant that you are authorised to use the chosen payment method.
7.3 Refund Policy
14-Day No-Quibble Guarantee
We offer a no quibble, 14-day money-back guarantee from the date of purchase on monthly agreements, provided that you have not accessed or otherwise used our Services and have not uploaded any content to Lumin XR’s servers within that period. The policy is “no quibble” and does not override the customer's statutory rights.
Case-by-Case Assessment
Where you have utilised the Services or uploaded Content, refunds will be considered on a case-by-case basis.
Custom or Bespoke Services
Refund terms for custom or bespoke services may differ and will be provided at the time of purchase.
Refund Processing
If approved, refunds will be processed via the original payment method within a reasonable timeframe.
7.4 Subscriptions, One-Off Purchases, and Cloud Hosting Fees
B2C (Consumers):
Annual Purchases: Consumers may buy products or templates outright for a one-off fee, which includes 12 months of cloud hosting. This will then renew unless otherwise cancelled. If you do not pay a renewal fee after the first 12 months, hosting may be suspended for the project cloud space.
B2B (Business Clients):
Recurring Subscriptions: Business clients may purchase monthly or annual subscriptions. These subscriptions include ongoing cloud hosting for any purchased products/templates at no additional cost.
Subscription Renewals: The subscription is an auto-renewable policy that can be cancelled before the renewal date to prevent repeat charges.
Price Changes and Notifications:
Lumin XR reserves the right to modify subscription fees, one-off purchase prices, and the annual 50% running fee. Any changes will be communicated in a timely manner and take effect upon renewal of your subscription or before the next annual hosting cycle.
Non-Payment and Service Suspension:
If you fail to pay any due fees, Lumin XR may suspend or terminate your access to the purchased products or Services, including cloud hosting.
8.1 Data Collection
We collect personal data when you create an account, make a purchase, or otherwise interact with our Services. This data may include names, email addresses, and billing information.
8.2 Data Protection
We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your personal data is stored securely and is only shared with third parties as required to fulfil our Services or as required by law.

We may suspend or terminate your access to our Services or website immediately, without prior notice or liability, if you breach these T&Cs or for any other reason at our sole discretion.
11.2 Effect of Termination

Except for liability arising from our negligence that causes death or personal injury, you hereby waive and discharge Lumin XR from any claims arising from physical injuries, property damage, or other losses related to the use of AR Services.
15.3 No Waiver of Mandatory Rights
Nothing in this Liability Waiver excludes or limits liability where such exclusion or limitation is prohibited by law, including for death or personal injury caused by negligence.

You accept full responsibility for safeguarding your environment while using the Services and for adhering to any instructions or safety guidelines provided.
